General Retail Industry Award penalty rates

Under the General Retail Industry Award 2020, penalty rates apply to ordinary hours worked on Saturdays, Sundays and public holidays – and the rates vary by day, employment type and classification level. Sunday rates are noticeably higher than Saturday rates; public holiday rates are the highest in the Award. For casual employees, the casual loading and the applicable penalty rate both apply separately. A common error is paying one without the other.

In a store running seven days, these provisions apply every single week. Across a team of ten or fifteen staff over a year of trading, consistent errors produce significant back-pay exposure. The Fair Work Ombudsman’s targeted retail campaigns are designed specifically to find them.

The exact percentage depends on the employee’s classification level and whether they’re full-time, part-time, or casual.

Casual employees receive both the casual loading and the applicable penalty rate. Both apply separately, not as an either/or. Applying only the casual loading on weekends without the penalty rate on top is a breach. Across a team working a seven-day roster, that error accumulates quickly.

Under the Fair Work Legislation Amendment (Closing Loopholes) Acts, a casual employee becomes eligible to convert to permanent employment based on their actual pattern of work – specifically, regular and systematic engagement – not the wording of their contract or your own assessment of the role. Eligibility isn’t something employers can prevent by keeping a ‘casual’ label in place.

For retail businesses, this means any casual who has worked regular, predictable hours over the relevant period should be assessed for conversion eligibility. Failing to provide a conversion offer when required is itself a breach of the Act. If the conversion would have entitled the employee to annual and personal leave, back-pay exposure can stretch back significantly. If you’re unsure where you stand, it’s worth getting advice early.

A Person Conducting a Business or Undertaking (PCBU) has a duty of care to ensure the health, safety and welfare of all workers, including casuals and labour hire. In retail, this means proactively managing psychosocial hazards such as customer aggression; lone worker protocols for staff opening and closing stores; manual handling risks; and ensuring everyone is adequately trained.

The obligation isn’t satisfied by a safety manual alone. Regulators look for documented, regularly reviewed systems that show the hazard has been identified, assessed and controlled.

ISO certification isn’t a legal requirement for most retail businesses, but it’s increasingly a practical one if you want to tender to large retailers, franchise networks, or government procurement. Retail ISO certification tells commercial partners your business operates to internationally recognised standards, with documented and auditable systems to back it up.

ISO 9001 (quality management) is the most common starting point. ISO 45001 (occupational health and safety) is worth considering if you want your WHS systems independently verified. A gap analysis comes first, so you know exactly what’s involved before you commit.
